Filing of Company Document

It is brought to your attention that under the provisions of section 2(iv) of the Advocates Law (as amended) any acts defined in the above section must be carried out by a registered advocate since these are considered as practising as an advocate.

“2(iv) the drafting, revision, amendment of any memorandum or articles of a company of any form or of any application, report, statement, sworn statement, resolution or other document/instrument which relates to the formation, registration, organization, reorganization or winding up of any legal person”.

As a consequence of correspondence and personal contact with the A.G. Office, the Department will not proceed to return to the applicants who are not registered advocates the documents which have been filed until today. However, it should be noted and emphasized that the above provision of the Advocate Law shall be fully complied with and implemented as from next Monday 16/06/2008. It is clarified that a document/form which was prepared/completed by a registered advocate can be submitted/filed by any person, provided of course that this can be verified.
