The main criteria of review of the form HE38 are:

• company name and number;
• details of receiver or manager;
• date of cessation;
• signature of receiver/ manager.

Attention: Prior the submission of form HE38 the form HE37, and HE39 or HE40 must be submitted accordingly to the appointment of the receiver/ manager (by creditor or by Court Order).

Most common reasons for rejection of the form by the examiner:

• the form submitted is not the statutory form. 
• the submission of forms HE37, and HE39 or HE40, did not precede;
• failure to complete/ submit the above details.
