Main criteria of review for registration of mortgage

The main criteria of review of the form HE24Y are:
- the company number must be similar to the company name;
- registration date of mortgage is no later than 21 days prior to the submission date at the Department. In case it is later than 21 days, a Court Order must be submitted for extension of period accompanied by the corresponding fee of twenty euros (€20,00);
- mortgage number must be similar to the registration date of the mortgage (e.g. Y (number)/(year) - Y140/2014);
- the Land Registry office where the mortgage was registered must be completed with the district where the mortgaged property is located and match the district written in the field description of property;
- property acquisition date: this field is completed when the property was acquired at a later stage than the registration date of the mortgage at the Land Registry. In such case, the mortgage date must also be completed;
- the amount secured by the mortgage must be completed. The mortgage cannot be registered without a secured amount;
- the field description of mortgaged property must state the type of immovable property (e.g. plot, field etc.), immobile property no., plot and area where the mortgaged property is located;
- mortgage beneficiaries: complete the full name of the natural person or organisation/company and full address details;
- the form must be signed by a director or secretary or the lawyer of the mortgage creditor.
Most common reasons for rejection of the form by the examiner:
- the form submitted is not the statutory form. The statutory forms are available on the webpage and at the offices of the Department;
- failure to complete/submit the above details.
